Who Is Liable in an Uber or Lyft Accident?
Uber and Lyft accidents can be slightly more complicated than regular car accidents because there are more potentially liable parties. Possible liable parties in rideshare accidents include the following:
- Rideshare Drivers – Your rideshare driver may have been negligent and caused the accident. If your driver wasn’t paying attention or drove carelessly or recklessly, they may be legally responsible for your injuries.
- Rideshare Platforms – Uber and Lyft are generally not legally responsible for their contractors’ driving but cover them with insurance in certain circumstances. However, the companies may be liable for their own negligence. If the company ignored your driver’s history of negligent driving, failed to conduct a sufficient background check, or otherwise negligently hired the driver, it could share responsibility for your accident.
- Other Drivers – Your driver and the rideshare platform may not have done anything to cause or contribute to the accident. If another driver hit the rideshare vehicle, they could be legally liable for the accident.
- Government Entities – If your rideshare accident occurred due to things like poorly maintained roads or construction site debris, a local government entity may share liability for your injuries.

Understanding Uber and Lyft's Insurance Policies
Rideshare drivers in Pennsylvania are subject to specific laws concerning required insurance policies.
All Pennsylvania drivers must have their own personal injury protection or PIP coverage. As a rider, if you have automobile insurance, you’ll look to your personal PIP insurer to cover your medical expenses and certain related costs. You can file a PIP claim no matter who is at fault for the accident.
If your Uber or Lyft driver caused the accident, the platform may provide liability coverage to drivers for riders’ injuries. This coverage is available only if the driver was “on the app” when the accident occurred, meaning the driver had logged on and was actively accepting rides or transporting a rider.
What Does Uber's Insurance Cover?
Uber’s liability insurance coverage depends on whether the driver had logged in and was transporting a rider. The following coverage applies as follows:
- If the driver was not logged into the app at the time of the accident, the company does not provide liability coverage.
- If the driver was logged in and actively transporting a rider, Uber provides $1 million in personal injury coverage, $1 million in property damage coverage, and $1 million in underinsured driver protection coverage.
- If the driver is available for riders but has not yet accepted a fare, Uber provides coverage of $50,000 for bodily injury per person, $100,000 for bodily injury per accident, and $25,000 coverage for property damage per accident.
What Does Lyft's Insurance Cover?
Lyft’s insurance is similar to Uber’s and applies as follows:
- Drivers who are not logged in are not eligible for liability coverage.
- Logged-in drivers with active fares are eligible for at least $1 million in third-party liability coverage.
- If the driver is available for riders but has not yet accepted a fare, Lyft provides coverage of $50,000 for bodily injury per person, $100,000 for bodily injury per accident, and $25,000 coverage for property damage per accident.
“You took an Uber and your driver caused the accident. Uber provides liability coverage for passengers who suffered serious bodily injuries in crashes caused by Uber drivers. So once you exhaust that PIP, personal injury protection, on medical treatment and care, you might be able to file a claim with Uber.”
- Steven Debonis, Attorney
What Types of Damages Are Available to Me After a Rideshare Accident?
Accident victims can pursue two main types of damages after a rideshare accident: economic and non-economic damages.
Economic damages compensate plaintiffs for the monetary losses resulting from another party’s negligence. These losses include lost wages, lost earning capacity, medical bills, property damage, and similar financial costs.
Non-economic damages compensate plaintiffs for the more subjective impacts on their lives. Such losses include pain and suffering, emotional distress, and loss of companionship.
A judge may also award punitive damages in rare cases. Punitive damages don’t compensate the plaintiff for something they had and lost. Rather, they aim to punish particularly egregious behavior and deter future misconduct.
What Kind of Compensation Has Cordisco & Saile Secured for Previous Clients?
The rideshare accident attorneys at Cordisco & Saile, LLC have an extensive track record of securing fair compensation for victims of car accidents in Pennsylvania. Notable results include the following:

Our attorneys can determine the damages available to you and pursue your legal options.
“Do you know the number one way to hurt, damage or kill your rideshare accident case? If you're not 100% honest throughout your case, it will be damaged. Any amount of exaggeration, untruthfulness, shading, will hurt or kill your case. So do yourself a favor, live an honest life, always tell the truth, and your case should have a good recovery.”

How Long Do I Have to File a Rideshare Accident Claim in Allentown, PA?
The statute of limitations for filing personal injury lawsuits in Pennsylvania is two years from the accident date. While this may seem like plenty of time to file a case, it’s critical to file your rideshare accident claim shortly after the accident.
Memories and evidence fade over time. Building a successful case becomes much harder the longer you wait after the accident to get started.
