How Can I Hold Someone Else Responsible for My Slip and Fall Accident Injuries?
Under Pennsylvania law, property owners and managers must protect others against an unreasonable risk of foreseeable harm. This duty requires removing or repairing hazards they knew or should have known existed as promptly as possible. Until repairs are complete, they must take reasonable steps to protect others from the hazard and warn them against it. If they fail to do these things, they may be liable for resulting injuries through an insurance claim or lawsuit.
Two notable exceptions to these premises liability laws exist.
Trespassers and Uninvited Guests
As the Pennsylvania Supreme Court reiterated in Antonace v. Ferri Contracting Co., property owners do not owe a duty of care to trespassers or uninvited guests. They also may not set up booby traps, intentionally make their property unsafe, or take other actions to injure trespassers on purpose.
However, in Bartleson et al. v. Glen Alden Coal Co., the Pennsylvania Supreme Court held that a property owner could be liable for injuries to a trespassing child if their property contains an attractive nuisance. This includes features such as swimming pools that could attract children onto the property and injure them.
Intoxication or Reckless Behavior
A property owner may not be liable if they can prove that the party injured on their property was either intoxicated or behaving recklessly or inappropriately. In these cases, people may be responsible for their own injuries.
Slip and fall claims can be hard to sort out. You might claim the property owner invited you to the premises as a guest, while the owner alleges you were a trespasser. Often, whoever makes the most convincing argument and offers the best evidence wins a slip and fall accident claim, which is why you need the skilled, tenacious team at Cordisco & Saile LLC. We’ll craft a strong argument in your favor so you can recover fair compensation for the harm you have suffered.
We’re ready to fight for you. Take the first step towards getting the compensation you deserve.

What Kind of Compensation Am I Eligible for After a Slip and Fall in Philadelphia?
Our Philadelphia slip and fall attorneys seek economic and non-economic damages after accidents so clients have a fair chance at full compensation. The damages we will pursue include:
- Medical bills: Medical costs could include hospital bills, doctor visits, rehabilitation, physical therapy, prescription drugs, and medical devices. We seek compensation for both current and expected future medical bills.
- Lost wages and reduced earning capacity: If you miss work while recovering from your slip and fall accident, we pursue your lost wages from the liable party. We also seek compensation if your capacity to earn a future living drops due to your injury.
- Pain and suffering: We build a strong and comprehensive case that you deserve additional, often significant, damages for the pain and suffering you endured. Pain and suffering are subjective, so your lawyer’s experience and skill in telling your story matter.
- Punitive damages: If the responsible party acted intentionally or maliciously or demonstrated a reckless disregard for your safety, we can seek punitive damages, which aim to punish the wrongdoer and deter future misconduct.
The average slip and fall settlement in Pennsylvania varies based on the circumstances of the case. Our respected personal injury attorneys have a history of positive case results, including $800,000 recovered for a client on a neighborhood stroll struck by a vehicle backing out of a driveway and $700,000 for a woman injured due to a parking lot pothole.
Slip and Fall Case Highlight
We are passionate about helping people injured by another party’s negligence. In one recent case, we represented a Bucks County woman who stepped in a deep, neglected pothole in a Bensalem shopping center. We pursued compensation against the large commercial real estate conglomerate that owned the shopping center and lot.
Our client rolled her ankle in the pothole and suffered ongoing numbness, swelling, tightness, and debilitating pain. She needed extensive orthopedic surgery on her ankle. She also developed complex regional pain syndrome, or CRPS, which traveled to other parts of her body, such as her leg, arm, and hand.
The defense’s medical experts contested that the injury in the parking lot caused her subsequent CRPS or ankle instability. After discovery, the exchange of expert reports, and mediation, we secured a $700,000 settlement.
