Insurance Issues You Can Face With Rideshare Accidents in Philadelphia
Uber and Lyft accidents and claims can present unique challenges for injury victims seeking compensation. Complex laws regulate Uber and Lyft, and multiple insurance policies may apply. The process is often complicated, discouraging many victims from pursuing claims.
Pennsylvania is a no-fault state. Thus, drivers and passengers must seek compensation from their personal injury protection coverage, or PIP, before suing the at-fault party. Generally, if you have an auto insurance policy, your policy provides PIP coverage. If you do not have a policy but live with a family member who does, that insurance applies. If neither you nor a household member has a policy, the policy covering the vehicle you occupy will provide PIP coverage.
Once the PIP coverage is exhausted, you may pursue compensation from an at-fault party. However, the damages you can recover depend on whether you selected limited or full tort coverage on your auto insurance policy. Limited tort means you can pursue your economic damages but only recover non-economic damages under certain circumstances, such as accidents resulting in “severe” injuries. Uber carries the following amounts of insurance for drivers, which come into effect depending on the driver’s status as follows:
- The rideshare app is off: Uber’s insurance doesn’t cover accidents when the driver is offline. In this case, victims can seek compensation from the driver’s personal auto insurance or other third parties.
- The driver is online and available to accept a ride: Uber provides limited insurance coverage for third-party liability per accident. This includes $50,000 for bodily injuries per person, $100,000 for bodily injuries per accident, and $25,000 for property damage per accident.
- The driver has accepted a trip or is in transit with the passenger: In this case, Uber maintains $1,000,000 for injuries, pain, and suffering, as well as property damage. Uber will also pay a settlement if the other at-fault driver is uninsured or underinsured.

Lyft’s insurance coverage also depends on the driver’s status at the time of the accident as follows:
- The rideshare app is off: If the app is off, Lyft provides no coverage, so the driver’s personal insurance—or your own underinsured motorist coverage—applies.
- The app is on, but the driver has not accepted a ride: When the app is on but the driver has not yet accepted a ride, Lyft offers limited, contingent coverage that only kicks in if the driver’s insurance denies the claim. This covers up to $50,000 per person for injuries and $25,000 for property damage.
- The driver has accepted a trip or is in transit to pick up a passenger or is transporting them: Stronger coverage applies when the driver is en route to pick up or actively driving a passenger, with at least $1 million in liability protection and possible uninsured motorist and collision coverage. However, collision coverage has a $2,500 deductible and only applies if the driver carries proper personal insurance with a rideshare endorsement.
