How Long Do Survivors Have to File a Sexual Abuse Claim in Pennsylvania?

As in many states, the deadlines for filing a sexual assault claim in Pennsylvania are continuously evolving. One major change happened in 2019, when the state extended the statute of limitations for child victims. Now, someone who experienced sexual abuse as a child has until age 55 to file a civil lawsuit. If the person was 18 to 23 years old when the abuse occurred, they have until age 30 to file.

However, those changes were not retroactive. Thus, the previous deadline applies to incidents that occurred after 2018. Minor victims harmed before 2019 generally have until their 30th birthday to file suit.

Adult victims typically have two years to file suit, but lawmakers frequently propose legislation that would affect this and other time limits. Select exceptions may also exist. An attorney can help you identify the window that’s most likely to apply in your case.
